Moi University staff face layoffs as revenue declines

Moi University has announced plans to lay off several employees, citing financial difficulties caused by a decline in student numbers.

In a notice issued on Wednesday, acting Vice Chancellor Kiplagat Kotut attributed the decision to a revenue shortfall that has made it difficult for the institution to sustain operations and meet financial obligations, including staff salaries.

“In accordance with Section 40 of the Employment Act 2007, Laws of Kenya, and the provisions of the Collective Bargaining Agreement (CBA) between Moi University and the Universities Academic Staff Union (UASU), we hereby give formal notice of an intention to declare redundancy affecting several employees who are members of your Union,” the notice read.

The notice noted that revenue constraints created a difficult environment to maintain operations within the institution, making it a challenge for the University to meet its financial obligations, including payment of employee emoluments.

The university's management stated that consultations with the affected employees and their union representatives were ongoing in accordance with the law and the UASU Collective Bargaining Agreement.

“As a result, we are compelled to review our operations and adjust the workforce accordingly to ensure sustainability of the University. During the notice period, we will engage in consultations with the affected employees and their Union representatives, in accordance with the law and the UASU CBA,” the notice added.

The university, however, noted they were exploring possible alternatives to minimise the impact of redundancy, including potential redeployment or alternative roles where possible in compliance with the provisions of the Employment Act, individual contracts, and the UASU CBA 2012/2013.

The institution has been facing learning disruption in the last few months owing to financial challenges and a lecturers' strike.

“The affected employees will be entitled to severance pay, salary in lieu of notice, payment for accrued leave days, and any other unpaid benefits. All necessary deductions will be made in accordance with statutory requirements,” the notice stated.

The university said details on the affected employees and the redundancy process timeline would be communicated in due course.
