Wheels of Justice: Court cases lined up for the day

In Summary
  • In a separate court, Justice Kanyi Kimondo will be mentioning the George Muchai murder case.
  • Justice Momanyi Bwonwong'a who was seized of the matter bowed out after attaining the mandatory retirement age of 70.

The High Court will be mentioning a case in which Lawyer Danstan Omari is challenging being questioned by DCI over former Interior CS Fred Matiang’i alleged home raid.

The orders suspending the DCI summons were issued after Omari told the court that at the material time, he had been engaged to render professional legal services by the former CS "who was under a real apprehension that the state had set out to arrest him in the wee hours of the night with a view of harassing him"

In a separate court, Justice Kanyi Kimondo will be mentioning the George Muchai murder case.

Justice Momanyi Bwonwong'a who was seized of the matter bowed out after attaining the mandatory retirement age of 70.

The matter has gone through different judges with others being transferred to other stations and now Bwonwong'a retiring.

Article 50 (2) (e) (l) & (4) of the Constitution requires that a trial be concluded without undue delay.

The Muchai murder trial has been in court since 2015 when they were first charged.

The mention is likely to indicate if another judge has been allocated the case to proceed with it.

The last time the matter was in court, government pathologist Dr Johansen Oduor said Muchai died out of multiple injuries caused by a single gunshot.

Oduor who is the prosecution's 35th witness said Muchai was shot at close range with either a G3 rifle or an AK47 gun.

He ruled out any possibility of a shotgun.

He told trial Judge Justus Bwonwong'a that the gunshot wound entered through the right side of his abdomen to his right nipple.

"The area was blackened. Meaning burning of the skin around the entry caused by fragments of metal and gunpowder," the witness said.

Muchai was dressed in a stained black suit at the time his body was brought to Lee funeral home in February 2015 for postmortem purposes.

He had a white shirt and a white vest.
