A man believed to be a Raila supporter accused of using abusive and threatening words asking "Baba" to go to Russia and bring guns has been charged at a Nairobi court.
Shadrack Omondi alias Omosh Jakababa one hour appeared before Milimani senior principal magistrate Gilbert Shikwe on Wednesday and denied one count of offensive conduct.
According to the charge sheet, Omosh is accused that while at a public gathering, he used threatening words, 'Baba enda Russia utuletee bunduki, maskari wote wakae raia, kila mtu apewe bunduki yake tuingie state house."
The prosecution said he uttered the words with intent to provoke a breach of peace on May 9 at an unknown place within the country.
The accused through his lawyer Danstan Omari asked the court to release him on lenient bond terms.
"I urge the court to release the accused on a cash bail of Sh5,000 as the charge sheet reads that he made some illegal utterances within a gathering which is not possible," Omari said.
"Your honor this is a political case that might not see the light of a full trial as the state is known for withdrawing charges.
"Omosh is a young man who is fighting for the rights of millions of Kenyans on the high cost of living, we urge this court to release him on reasonable bail terms."
The magistrate released him on a cash bail of Sh50,000 or a bond of Sh100,000.
The case will be mentioned on August 2.
On Monday, police said they had completed the investigations after the court granted them seven days to detain Omosh.
Police had alleged that Omosh is believed to be behind a Tiktok video where he allegedly said that Baba should go to Russia and procure guns for his supporters to invade the state house.
The prosecution, however, sought three days to peruse the evidence to know if it was substantive to charge Omosh.
Omosh was arrested in Kisumu on Monday, July 10, 2023.
"We believe that the averred publication went further to state and appear to indicate that once they acquire the purported weapons, they would be able to face off with the law enforcement officers," the officer said.
