MP Chonga, Speaker Mwambire released on Sh50,000 bail

They were released on Monday morning after spending the weekend at the port police in Mombasa.

Kilifi South MP Ken Chonga and County Speaker Teddy Mwambire have been released on a Sh100,000 bond or an alternative cash bail of Sh50,000. 

The two alongside their two co-accused persons, and their aides, were released on Monday morning after spending the weekend at the port police in Mombasa.

This is after Mombasa Chief Magistrate Martha Mutuku deferred the ruling on whether they were to be released on bond or not last Friday.

This was due to time constraints accessioned by the submissions from the prosecution and defence counsel.

The matter will be coming up for pre-trial on August 7.

Addressing the media shortly after their release, lawyer Danstan Omari said that this was a win for democracy.

He further alleged that there was a plot targeting to arrest and harass Azimio MPs and supporters.

“There is a fierce war being staged against Azimio MPs and supporters in the country, we all saw how they were targeted last week and many were arrested and taken to court,” he claimed.

"But the ruing this morning is a win for the Constitution.”

He said the leaders could have easily been called to the police and they would have reported.

Mwambire and Chonga vowed that they will not be cowed in their fight for their people.

Chonga and Mwambire together with two others were arrested in Mtwapa last Wednesday.

The four spent a night at Shimo la Tewa Prison as they waited for a ruling on their bond application Friday.

On Thursday afternoon, the four were charged with participating in unlawful assembly contrary to Section 78(1) as read with Section 79 of the Penal Code Chapter 63 of the laws of Kenya.

The Azimio la Umoja One Kenya Alliance had sent lawyers to represent the two leaders and their two co-accused alongside 16 others arrested in Mombasa.

The lawyers were led by senior counsel Jared Magolo, Danston Omari, Cliff Ombeta, Mombasa senator Mohammed Faki and his Kilifi counterpart Stewart Madzayo among others.
