Court orders release of Babu Owino's phone

Calvin Gaucho has also been asked to file his complaint of assault in any police station

A Nairobi court has directed OCS industrial area to release Embakasi East MP Babu Owino's mobile phone once done with forensic investigation.

The magistrate further directed the second accused person Calvin Gaucho to file his complaint of assault in any police station within Kilimani's jurisdiction.

The case had come up today before Milimani senior principal magistrate Esther Kimilu for a mention of allegations of torture and release of their mobile phones.

"All other accused mobile phones to be released as soon as the forensic analysis is done," the court directed.

Gaucho had claimed and complained to the court that the investigating officer slapped him and that he was assaulted during his arrest.

The case will be mentioned on August 3.

Last week, Babu Owino, Gaucho and five others were released on a cash bail of Sh100,000 each.

They are accused of conspiring to plan and organize demonstrations.

Milimani chief magistrate Lukas Onyina noted that the charge against the accused persons is punishable upon conviction for imprisonment for a term not exceeding seven years.

Onyina said one of the reasons advanced by the prosecution was that the witnesses are most likely to interfere with witnesses.

However, he said the prosecution was not clear on which of the accused persons would interfere with witnesses.

Also released on bond were Tom Odondo, Michael Otieno, Pascal Ouma, Kevin Wambo and Willys Owino.

The seven have since denied conspiring to commit subversive activities which are prejudicial to public order. 

They allegedly committed the offence on dates between July 7 and 23, with others not before the court within Nairobi.
