A police report filed at Kimilili Police Station, seen by the Star, stated that the arrest was made after one businessman, Benard Nabiswa, went to the police station to report a commotion at a nightclub.

Police officers immediately responded and went to the scene.

"We established that one PC Ben Victor Mbugua of Misikhu Police post in Webuye East Sub County who appeared drunk and disorderly was fighting with one Elias Opili a Luhya male adult, a businessman in Kimilili Town, who was also drunk, over one Miss Diana Naliaka a Luhya female adult aged 22 years," the OB report read in part.

The OB report adds that PC Mbugua had gone to the club in the company of two male friends while the civilian, Opili, had gone to the club with the said lady.

"Elias Opili was the one accompanied by the above-mentioned lady, but in the process, PC Mbugua confronted him with an intention of snatching the lady from him and as a result a confrontation ensued," the OB report stated.

The officer, OB report states, rushed to his vehicle, withdrew his G 3 rifle from the boot and fired one round of 7.62mm in the air.

Police officers disarmed their colleagues while being assisted by members of the public.

A total of 18 rounds of 7.62mm and one spent cartridge were recovered at the scene.

Four people were arrested including Kevin Barasa, a police officer from Misikhu Police Post, who allegedly attempted to rescue PC Mbugua from lawful custody.
