Ex-MP summoned before Mombasa court over corruption-related charges

Orders come after he reportedly evaded an arrest by EACC officers in December 2023

A former Mandera South MP has been summoned before the Mombasa Court.

In orders issued on January 30, the Mombasa Chief Magistrate's Court directed the former lawmaker to appear before it on February 13, to take a plea.

The accused is facing a charge of conflict of Interest contrary to section 42 (3) as read with section 48 of the Anti-Corruption and Economic Crimes Act, 2003.

The orders came after he reportedly evaded an arrest by Ethics and Anti-Corruption Commission (EACC) officers in December 2023.

He is wanted by the Commission to answer to the charge involving over Sh51 million public funds he is accused of perpetrating when he served as the County Executive Committee (CEC) Member in Kwale County.

EACC believes that the former MP went into hiding after the Director of Public Prosecutions (DPP) concurred with the Commission's recommendations for his apprehension and charging before the Mombasa Anti-Corruption Court.

Following his disappearance, the anti-graft agency obtained directions from the ODPP and registered the charge sheet in the court.

It then secured the summon compelling the former MP's appearance to answer to the aforesaid charge.

Before the decision to charge the accused, EACC carried out investigations after receiving allegations that during his tenure in Kwale, he used his hotel to trade with the county.

The offences were allegedly committed between May 10, 2013, and May 10, 2017, when it is suspected that he obtained Sh51,456,006 from the county.

The Commission further established that during the tender and award process, the former lawmaker never disclosed his private interests in the hotel to his employer, the county.

Following the probe, EACC forwarded the resultant file to the DPP, who on December 20, 2023, concurred with the recommendations to charge the former MP.

"Between May 10, 2013, and May 10, 2017, within Kwale County in the Republic of Kenya, being an employee of the Kwale County Government, you directly acquired a private interest amounting to Sh51, 456,006 in the tenders for prequalification for provision of accommodation and conference services during Financial Years 2014-15, 2015-16 and 2016-17 to Kwale County Government, in which a company you were a director was prequalified and awarded contracts," the charge sheet presented in court reads.
