The High Court has directed the Law Society of Kenya to serve Agriculture CS Mithika Linturi with its petition challenging the implementation of the National Fertiliser Subsidy Programme (NFSP).

Justice Lawrence Mugambi said LSK has seven days to serve its petition to the CS.

Others to be served include PS Agriculture, the National Cereals and Produce Board, Kenya Bureau of Standards, the Attorney General, KEL Chemicals Limited, the DPP among other respondents.

The respondents will then be required to respond in 14 days.

LSK in its court papers says there is need to halt the continuation of the NFSP to allow room for public scrutiny into the progress of the programme.

"The scrutiny will be in respect to the intricate scheme to defraud farmers through sale of fake fertiliser, " the documents read.

LSK argues the NFSP was marred with alleged fraud and the courts should intervene by restraining the Ministry of Agriculture from further implementing the programme.

LSK said this should be until all farmers who fell victim to the alleged substandard fertiliser are compensated and proper public participation on the implementation of the programme is conducted.

Also sought is an order directing the ministry to make public all tender documents and other relevant information relating to the procurement and distribution of fertiliser to farmers under the NFSP.

"The respondents are seized with information that is crucial to these proceedings," LSK says.

"The restricted nature and limited scope of the parliamentary and impeachment proceedings have left the matter gravely unresolved," LSK adds.
