Says key witness who took Masai to hospital have not come forward to record statements

Director of Public Prosecutions Renson Ingonga has issued an update on investigations regarding the alleged shooting of protesters by police.

He said his office received files from the Independent Policing Oversight Authority (Ipoa) regarding four victims of the alleged police shootings.

Among them is a file on the death of Rex Masai on June 18 along Moi Avenue.

Ingonga said CCTV footage obtained on the material day does not distinctly identify the individual who pulled the trigger.

"The CCTV footage showing the shooting does not identify the person who pulled the trigger," Ingonga said.

The DPP said that investigations show Masai's relatives identified the body for post-mortem.

He, however, added that the people who took Masai to the hospital, the key witness who was with him during the shooting and who informed the deceased's parents after the incident occurred have not come forward to record statements.

"I call upon any person with information pertaining to this case especially the witnesses who took the deceased to the Hospital and those who witnessed the shooting to come forward and record a statement with Ipoa," he said.

Another victim of the shooting is Evans Kiratu Karobia who died while undergoing treatment at the Kenyatta National Hospital (KNH).

DPP said that Investigations show that the cause of death was identified as multiple organ injuries due to blunt force trauma.

"No person has recorded any statement regarding the incident of the deceased being assaulted. I have directed Ipoa that this matter be placed before a competent court for a public inquest," Igonga said.

He called on any person with information to record a statement with Ipoa.

He said the statements would help the state ascertain the cause of the injuries noted in the post-mortem report.

In the File of Gianna Obonyo who was shot on June 25, 2024, she sustained a gunshot wound in the lower back while riding a bicycle in her parents' compound.

DPP said that she was admitted to KNH and underwent surgery to remove the bullet.

He pledged to review the case and make further directions once the investigations file is resubmitted with the ballistics report to his office.

Ingonga said that in the case of Dominic Mutua, the suspect denied firing a teargas canister at him.

The DPP further directed that further investigations be conducted to authenticate the video and a report submitted by the Communication Authority of Kenya (CAK) showing the alleged incident. 

He directed that a report from the ballistic examiner be availed to his office for review.

He said there are pending cases before various courts involving police officers including three in Laikipia, three In Meru and one in Taita Taveta.

Ingonga further said that he is working on a case involving the death of baby Samantha Pendo which occurred during protests in 2017 and the Kianjakoma brothers, who were last traced to police custody in 2021.
