Teachers union KUPPET has refused to suspend their strike, which began on Monday, despite a Labour Court order on Tuesday to halt the action.

Union Secretary Akelo Misori stated on Wednesday that the strike will continue.

"The court talked about the intended strike yet the strike had already begun. TSC went to court on Tuesday when the strike had already begun so we cannot call it off on the basis of those orders," Misori said.

Misori vowed that teachers will not back down.

He said they had already begun talks on the return to work formula with Labour CS Alfred Mutua before TSC moved to court putting the talks in jeopardy.

The High Court on Tuesday suspended the post-primary education teachers' strike called by Kuppet pending the hearing and determination of a case filed by the Teachers Service Commission.

Justice James Rika of the Employment and Labour Relations Court in Nairobi issued the orders on Tuesday.

He certified the petition by the Teachers Service Commission as urgent.

Education CS Julius Ogamba said the ministry appreciates the critical role teachers play in the education ecosystem and cannot take them for granted but pointed out that seamless operation in schools is critical, particularly this term as learners prepare for national assessments and exams.

“This is why, as a government, we will do all we can to improve their terms and conditions of service. Already, resources have been provided for the implementation of the 2021–25 Collective Bargaining Agreement,” Ogamba said.

The CS spoke at Lenana School Primary in Kajiado County at the end of his assessment tour in a number of primary schools in Nairobi, Machakos and Kajiado counties as learners reported for the third term.
