LSK sues Nairobi county over directive to dispose unclaimed bodies

They allege that the county has not given people sufficient time to identify the bodies

The Law Society of Kenya wants the county government of Nairobi compelled to conduct a DNA sampling process to ascertain the identity of the 120 unclaimed bodies they intend to dispose.

The bodies are lying at the Nairobi City Funeral Home (City Mortuary).

A week ago, Nairobi Governor Johnson Sakaja made the announcement that they intend to dispose of the bodies.

A notice was issued in one of the local dailies indicating that the bodies were dropped off by police officers from 12 police stations in Nairobi between May 12, 2023, and April 28, 2024. Most of the bodies are male.

The LSK, in its case before the Milimani Law Courts, has asked the court to issue an order suspending the notice pending the determination of their matter.

They allege that the county, its governor, and other parties have not given people sufficient time to identify the bodies, nor have they conducted a proper and extensive DNA sampling process to identify the unclaimed bodies.

Those sued in the case are the County Government of Nairobi, the Governor, the Acting County Secretary, CEC Health, Nairobi City Mortuary, CS Health, the Inspector General of police, the Directorate of Criminal Investigations and the Attorney General.
