Masengeli tenders apology to court, says his actions were not deliberate

Deputy IG Gilbert Masengeli has this afternoon apologised to the court and the Judiciary for the events that transpired leading to his conviction and sentencing.

Masengeli took to the stand and explained that his actions were not deliberate.

He told Justice Lawrence Mugambi that he was involved in national security issues that required his sole attention in the northern part of Kenya.

"I respect you and all our courts for the good work you do to uphold the rule of law. As a police officer, it is my duty to enforce court orders and ensure court orders are obeyed," Masengeli said.

"I pray that this court accepts my apology and vacates conviction and sentence."

He told the court that efforts were made regarding the disappearance of the Kitengela three and investigations are still underway.

Masengeli maintains that the Kitengela three were never in their custody but has this morning learnt from advocate Nelson Havi that they have been found.

Havi made the statement in court early this morning when he was submitting the matter.

"I am not above the law. I have obeyed court orders," Masengeli said, as he defended his right to continue holding public office.
