How Gachagua’s impeachment trial will unfold at Senate

The reading of the charges will be held for 30 minutes, from 10:30 am to 11am.

The Senate is expected to begin the impeachment trial of Deputy President Rigathi Gachagua on Wednesday.

The hearing, which will be plenary after a motion to set up a special committee failed to get a seconder, will go through to Thursday.

Speaker Amason Kingi on Wednesday said the hearing “is yet another opportunity for the Senate to demonstrate its fidelity to the Constitution and live up to its reputation.

Kingi has since released a program for the two days, showing that from 9am to 10am, there will be a closed session for a pre-hearing meeting for the senator.

From 10am to 10:30 am, there will be preliminaries including the recital of the mandate of the Senate, rules of procedure and hearing programme, introduction of members of the National Assembly representing the House, and their Counsel, if any, and introduction of the DP and the Counsel representing him, if any.

The reading of the charges will be held for 30 minutes, from 10:30 am to 11am.

From 11am to 11:30am, there will be an opening statement on behalf of the National Assembly and in the next 30 minutes, the opening statement on behalf of the DP.

The tabling of the evidence by the National Assembly including (evidence of witnesses, if any, cross-examination and re-examination) will be held from noon to 1 pm.

Kingi stated that there will be a total of three hours for the evidence of the National Assembly and a total of two hours for cross-examination.

The members will break for lunch at 1pm and resume the sitting at 2:30pm.

From 2:30pm to 6:30pm, the National Assembly will continue tabling its evidence.

The House will then have room for questions and requests for clarification by senators from 6:30pm to 7:30pm.

The Senate will then adjourn until Thursday at 9am.

From 9am to 1am, Gachagua will be allowed to table (Evidence of witnesses, if any, cross-examination and re-examination).

Similarly, Kingi has slated a total of three hours for the evidence of the DP and a total of two hours for cross-examination.

The House will break for lunch from 1pm to 2:30 pm.

It will then resume with Gachagua’s evidence until 3:30pm.

There will be an hour window for questions and requests for clarification by senators between 3:30pm to 4:30pm.

From 4:30pm to 5:30pm, there will be a closing statement on behalf of the National Assembly and a closing statement on behalf of the DP up to 6:30pm.

The House will then debate the motion on the proposed removal from office, by impeachment, of Gachagua from 6:30pm to 8:30pm.

Members of the House will hold a vote at 8:30m and adjourn.

On Tuesday, MPs voted to impeach the DP, with 282 voting in favour, 44 against, and one abstaining, following a motion tabled by Kibwezi West MP Mwengi Mutuse.

To survive the impeachment, Gachagua will have to get 23 votes from the Senate.

In the event a member is absent during the session or abstains from voting, that will work in the DP’s favour.
