City traders charged with Sh230 million land fraud

The magistrate released them on a Sh1 million bond with an alternative bail of Sh600,000.

Two city traders have been charged with conspiracy to defraud a businessman of land worth Sh230 million. Jacob Mwangi Mungai and Patrick Magu Kamau were both charged before Milimani senior principal magistrate Gilbert Shikwe with another count of forgery.

The charge sheet showed they jointly and with others, not before the court forged a letter of allotment for the land measuring 3.2 acres with the intention of committing a fraud.

The offences were allegedly committed on or before June 16, 2010, within Nairobi. The land in question is said to be registered in the name of the Bahati Development Welfare Association.

Mungai faced a third count of uttering a false document by telling the deputy registrar at the Milimani law courts in Nairobi in 2021 that the allotment letter he had was genuine and had been issued by the Nairobi City county government.

The accused persons pleaded not guilty and asked the court for lenient bond terms.

Their lawyer urged the court to release them on a reasonable bond term arguing that they were small businessmen and that the amount cited in the charge sheet was exaggerated to frustrate the accused persons.

The magistrate released them on a Sh1 million bond with an alternative bail of Sh600,000.
