Former Chief Justice Willy Mutunga has called on Kenyans to join him and others in court as the hearing for the case against the new University Funding Model begins.
In a statement on X, Mutunga insisted that even as the hearing begins, the new funding model must fall.
He noted that those opposing the new model are on the right side of history and they will continue to push for change.
The former CJ added that they will always stand against officials whose interests clash with those of Kenyans who want a good future for the country.
“And with our rusty rifles and worn-out boots we shall keep marching forward to victory. We fashion our struggle against the comforting understanding that history is on our side and that for the sake of our prosperity and posterity, we shall continue to stage spirited fights against state sluggards whose pluralistic and selfish power strategies conflict with our collective desire for a meaningful future," Mutunga said.
“On this we say, the New University Funding Model must fall. Tomorrow we make the courts our battleground. Let all Comrades of Goodwill join us tomorrow for the hearing session."
The new model has faced a number of obstacles in the form of Court cases against its implementation from various civil society groups and individuals.
On October 2, the High Court halted the implementation of the new university funding model.
Justice Chacha Mwita ordered the model to be temporarily halted pending the hearing and determination of a case filed by the Kenya Human Rights Commission (KHRC) last year.
The judge noted that the case was long overdue due to the delay by the Attorney General, Education CS and the Kenya Universities and Colleges Central Placement Service (KUCCPS) in filing their submissions.
The funding places students into five bands based on their financial needs through a Means Testing Instrument (MTI).
The instrument determines the appropriate financial
assistance each student needs based on information such as family background
and monthly income among others.
