The process of cancelling the controversial multimillion-dollar airport expansion deal with the Adani group is still underway, a Nairobi court heard on Monday.
Advocate Ochieng Oduol told Justice Chacha Mwita that the Public Private Partnership (PPP) committee has given the go ahead for the cancellation which is subject to approval by the Attorney General Dorcas Oduor.
He requested the court to grant them two more weeks as there are several processes that involves the Kenya Airports Authority and other parties before the same is concluded.
The case which was filed by the Kenya Aviation Workers Union is similar to other matters pending before Justice Bahati Mwamuye. Based on this, the Judge asked parties whether the file should be placed before Mwamuye for consolidation to which they declined.
The advocates told the Judge that the other matters before Mwamuye entail broader questions touching in the entire structure and the public private partnership act.
"Ours is limited to the procurement that was going on," said one of the advocates.
The judge subsequently gave them a date for February 18 next year for them to report to court with the status of the matter.
The union filed the case in court citing violation of public procurement law.
Kawu says the board of directors of Kenya Airports Authority did not consider or authorise the receipt of forwarding of the Adani group pip proposal to Treasury CS and directorate of public private partnership.
An order issued last month blocking the state corporation and other parties from signing a concession agreement pertaining to JKIA with the Adani group remains in place.
