Kajwang’ urges sober impeachment debate

Senator said upper House will strictly follow the law

Homa Bay Senator Moses Kajwang’ has pleaded with lawmakers to thoughtfully consider the impeachment motion against Deputy President Rigathi Gachagua.

He said senators are prepared to debate Gachagua’s proposed impeachment when the motion is brought before the Upper House. MPs are in the initial stages of the process.

The motion, which has already been brought before the National Assembly, was open for public views last week.

Kajwang said the Senate will follow the law when the National Assembly’s resolution is brought for discussion.

“As stipulated in the constitution, the Senate makes the final decision on removal of the President, Deputy President or a governor from office. Let MPs debate the matter with a lot of keenness and rise above partisan politics for justice to prevail,” Kajwang said.

Speaking at Kanyadhiang’ SDA in Karachuonyo constituency on Saturday, Kajwang suggested legal changes to make it simpler for Kenyans to recall National Assembly members. It is simple to remove governors, presidents and deputy presidents but extremely challenging to recall members of Parliament.

“I will be proposing some amendments to the law. It is very easy to impeach a president, deputy president and governor but it is impossible to remove MPs from office,” the senator said.

Despite being elected by millions of voters, the President and Deputy President can only be removed from office by 45 senators. It requires 31 senators to impeach a governor. MPs should be removed from office if the High Court finds them guilty of a crime, he said.
