Justice Aggrey Muchelule's tribunal has submitted the report on the removal of the four embattled IEBC commissioners to President William Ruto.
Led by Justice Aggrey Muchelule, the team presented the report at the State House on Monday.
The team recommended the removal of the last-standing member of the four, commissioner Irene Masit from office.
The tribunal however said on their appointment, they are not mandated to deal with issues touching on eligibility, recruitment and appointment of the Commissioner.
"As we deal with this issue, we are reminded of our mandate under Article 251 of the Constitution and the Gazette Notice No. 14890 appointing this Tribunal. In our respectful view, our mandate is limited to whether or not the Commissioner should continue serving as a member of the IEBC," it said.
It said the allegations against Masit, including gross misconduct and violation of the constitution, were proven.
"This tribunal recommends to Your Excellency, the President of the Republic of Kenya, pursuant to the mandate assigned vide Gazette Notice No. 14790 of December 2, 2022, and further in accordance and in compliance with Article 251 (1) and (6) that Commissioner Irene Cherop Masit be removed from office as a member of the Independent Electoral and Boundaries Commission," the reports read in part.
Receiving the report, Ruto said all Kenyans ought to submit to the Constitution and resist any urge to break it.
"We must submit ourselves to the letter and spirit of the Constitution and resist any temptations to defy, undermine or subvert the rule of law," he said.
"The Constitution is the cornerstone of our Republic, the foundation of every public institution and the guiding document for every public servant."
He did not specify how long he has to take before acting on the recommendations.
