I didn't see Babu Owino with gun - DJ Evolve

Felix Orinda alias DJ Evolve testifies virtually from home during the defence hearing of Embakasi East MP Babu Owino in a case where the politician has been charged with behaving disorderly while carrying a firearm following a shooting incident at B-Club in Kilimani. The DJ was injured on the fateful day.

Felix Orinda alias DJ Evolve has told a Nairobi court that he did not see Embakasi East MP Babu Owino alias Paul Ongili with a firearm at a Nairobi Club on the day he was shot.

Orinda told Milimani senior Principal magistrate Bernard Ochoi on Thursday that on the night of January 16th and 17th 2020, he met Owino at B club where they had conversations like old friends.

He said he had met Babu Owino in 2014 and had no squabbles. 

"When I met Owino, he had no gun at the Club and I never saw a firearm that shot me".

"I was having conversations and the next thing I was in a vehicle going to the hospital. I did not see where the bullet came from," Orinda testified.

Orinda was testifying in defence of Babu Owino who is charged with misuse of a gun that was linked to his shooting at the club in 2020.

The DJ also confirmed to the court that Owino has been supporting him since the incident.

"Owino has been supporting me and continues to support me. I have received medical, utility and general well-being support. No other person has come to support me," he added.

Owino's second witness who was his bodyguard, Edwin Otieno also confirmed to the court that his firearm had jammed after a previous shooting range.

He said at the time of the incident, he was a private protection officer and personal assistant to Owino.

On a fateful day, Otieno said he had asked Owino to take the gun for a check-up since it had a technicality. 

"I had told Babu Owino to take his gun for a check-up after he said it jammed. I checked and noticed that the firearm had a technical issue," he told the court. 

He said a gun cannot fire if it has jammed.

Otieno testified that they went to the club and he saw his boss Owino take two cans of energy drink and water.

He left the club at 5am and told the person in charge of security at the club Charles Otieno to hand Owino the firearm. 

He refuted the allegations that Owino used the firearm as it has never happened that a gun can be returned to its owner before leaving the club.

Charles Otieno, a security officer at Bclub confirmed that he is the one who kept Babu Owino's firearm at the club safe and gave the firearm back to Babu in the car while taking DJ Evolve to the hospital
