Four charged with conspiracy to steal diesel worth Sh13m

They are also facing charge of stealing with the alternative of handling stolen goods.

Lewis Musau Masaku, Evan Njuguna Mweha, Dominic Kimotho and Douglas Macharia Maina at Milimani Law Courts where they have been charged with conspiracy to commit felony by stealing seventy thousand litres of diesel worth Sh13 million on January 24, 2023.

Four men have been charged with conspiracy to commit a felony on diverse dates between November 23, 2023, and December 20, 2023, within Nairobi County.

Douglas Macharia Maina, Dominic Kimotho, Enan Njuguna Mweha and Lewis Musau Masaku are suspected of having conspired to steal seventy thousand litres of diesel worth 13,580,000.

When they were presented before Milimani Court Senior Principal Magistrate Bernard Ochoi on Wednesday, he heard that following the conspiracy, they proceeded to steal the diesel belonging to Petrocity Energy (K) Limited.

As a result, the accused persons are also facing the count of stealing contrary to the law.

The prosecution presented an alternative count charging Douglas Macharia Maina with handling stolen goods.

"Douglas Macharia Maina on diverse dates between November 23, 2023, and December 20, 2023, at 360 Energy Komarock petrol station within Nairobi County in the republic of Kenya, otherwise than in the course of stealing, dishonestly received or retained thirty thousand litres of diesel worth Sh5,820,000 knowing or having reason to believe that they were stolen goods, " the charge sheet read.

Dominic Kimotho was also charged with handling stolen goods as an alternative to the second count.

He is accused of dishonestly receiving or retaining ten thousand liters of diesel stolen from Trojan petrol station Kiboko.

The litres retained were valued at Sh1,940,000.

The two other suspects; Evan Njuguna Mweha and Lewis Musau Masaku, were also charged with the offence of handling stolen goods worth ten thousand litres of diesel stolen from the Industrial Area depot.

The diesel was worth Sh1,940,000.

The suspects denied the charges and the court released them on a bond of Sh2 million each with an alternative of Sh500,000 cash bail each.

The case will be mentioned on February 7, for pretrial.
