Barely five days after her acquittal in Monica Kimani's murder case, the Office of the Director of Public Prosecutions made clear its decision to challenge the decision freeing Jacque Maribe.
This among others are the major court decisions that took place during the week.
Maribe's acquittal in Monica Kimani murder case to be challenged
The office of the Director of Public Prosecutions will be appealing against a High Court decision that acquitted former TV News anchor Jacque Maribe in the murder of businesswoman Monica Kimani.
In the notice of appeal, the ODPP said they are dissatisfied with the decision of trial Judge Grace Nzioka and they will appeal part of the judgment that set her free.
Maribe was acquitted on Friday last week as her co-accused Jowie Irungu was convicted of the murder.
He is currently at Industrial Area remand awaiting sentencing on March 8.
Murder suspect Kevin Kang'ethe detained at Nairobi Remand
Murder suspect Kevin Kang'ethe is being held a Nairobi remand and allocation prison pending his extradition proceedings.
This is after Milimani Chief Magistrate Lucas Onyina allowed the application by the office of the DPP saying it would be inappropriate to have him remanded at a police station even for his safety.
Onyina noted that the submissions by the state that he escaped from lawful custody had not been disputed.
He added that there was no explanation of how he managed to escape, whether he did it on his own or was aided by other persons.
"Based on the circumstances, any escape must be subject to investigations and it would not be proper to have him remanded at Muthaiga or any other police station," he said.
State dealt blow as court stops privatization of sugar factories
The government was dealt a blow after the court suspended its decision to lease out five public sugar factories to private companies.
High Court Judge Chacha Mwita issued the order following an application filed by Martin Nyongesa Baraza.
"An interim conservatory order is hereby granted halting the tendering process under the international tender notice No. MOALD/SDA/IT," the order read.
The court's directive will remain in force until April 19 when the matter will be heard.
In the meantime, Nyongesa is to serve his papers on CS and PS Treasury, the State Department for Agriculture and the Attorney General.
Two men found guilty of possessing IED to commit an act of terrorism
Two men were on Tuesday found guilty of possessing Improvised Explosive Devices (IEDs) including seven projectile bombs to commit a terrorist act.
Abdimajit Hassan Adan and Mohamed Osman Nane were convicted on nine counts related to the act.
Delivering the judgment, Senior Principal Magistrate Zainabu Abdul said the prosecution had proven that the two were found with 36 hand grenades and five specified firearms with AK47 rifles, on February 15, 2018, at Merti in Isiolo County.
Hassan and Osman were also found guilty of possessing ammunition.
Another of their co-accused Lydia Nyawira Mburu was convicted of forgery of official documents on February 15, 2018.
The court acquitted two people in the case.
Hassan, Osman and Nyawira will be detained at Kamiti Maximum Prison and Lang'ata Women's Prison, respectively, awaiting mitigation and sentencing on February 27, 2024
Court extends orders freezing junior KeRRa officer's accounts
The High Court extended orders freezing accounts belonging to Daniel Munywoki Wambua, a junior official at the Kenya Rural Roads Authority.
This is after EACC applied to have the period extended pending the conclusion of investigations into how he amassed Sh21 million in four months.
When the matter came up for directions on Monday, counsel for EACC told Deputy Registrar, Anti-Corruption Court Emily Nyakundi that they had obtained extension orders on February 9.
Nyakundi was holding a brief for Justice Nixon Sifuna.
Lawyer Lunyolo Culent further stated that orders had already been served to the respondents, explaining their absentia in court.
