A court has stopped a former city councillor from interfering with a parcel of land in Eastleigh which he sold to a businessman 15 years ago.
Josphat Kiragu Waichahi was sued by businessman Abdullahi Sheikh for double-selling the land.
The businessman bought the land from the politician in 2009 for Sh13 million.
A sale agreement dated August 18 2009 that was filed in court shows Sheikh bought four plots from the former councillor and later amalgamated them into one.
The suit was prompted by a third party, John Mugo, who reportedly invaded the property claiming ownership.
Milimani senior principal magistrate P K Rotich has since issued orders that status quo to be maintained on the suit property until the matter is heard and determined.
"A status quo is hereby preserved pending the hearing of this matter, meaning that the suit property shall not be sold, transferred or developed by any of the parties pending the hearing and determination of this matter," Rotich said.
Sheikh claims the raid left his steel-structured concrete foundation worth Sh85 million damaged.
Sheikh has accused Kiragu, a former Eastleigh South councillor, of selling the same land to Mugo in 2023 for Sh20 million.
On April 4, last year, City Hall notified Kogai and Co. Advocates, the company through which the sale was done, that the land was first allocated to four firms associated with the former councillor and it was later sold to Sheikh.
City Hall approved the amalgamation of the plots into one parcel. It also approved a building plan for the amalgamated parcel before Sheikh laid a multi-million steel-structured concrete foundation for construction of a storey building with a basement parking.
The court has since restrained Kiragu, his family, agents and servants from alienating, or causing to be alienated, sold, disposed of and or in any manner, dealing with the suit property.
In his orders, magistrate Rotich directed OCS California police station to enforce the injunctive orders.
Mugo has since been enjoined in proceedings as an interested party.
