DP Rigathi Gachagua was impeached by the National Assembly on October 8 and by the Senate on October 17, 2024.
Gachagua’s legal team has challenged the legitimacy of his impeachment by Parliament, presenting several arguments in court.
They claim that Parliament’s Standing Orders, which provided a 12-day impeachment window, were illegal.
Additionally, they argue that the National Assembly introduced issues irrelevant to the original impeachment motion, including discussions on trivial matters such as eating maize and bananas, which were used in support of the impeachment.
Public participation in the process was also criticized as flawed, with Gachagua's lawyers noting that the number of impeachment supporters in some areas exceeded the actual attendees.
