The trial case of murdered university student Sharon Otieno will proceed today with the prosecution expected to call its 28th witness to the stand.
On Monday a taxi driver gave evidence in the case on how he assisted a journalist who allegedly managed to escape from the hands of his abductors on the night Sharon was murdered.
Kennedy Onyango Kasera told trial Judge Cecilia Githua that the Journalist sought refuge in his house near the main road in Owade area, Homa Bay.
Owade is the place where Sharon’s body was found.
Former Migori Governor Okoth Obado and his aides Micheal Oyamo and Caspal Obiero are currently in court facing trial over the murder of Sharon and her unborn baby.
The three and others not before the court are accused of committing the crime on September 3, 2018, at Owade, Homa Bay County.
Kasera said on that fateful day, he heard screams coming from outside his house.
It was around 20:30 hrs. He was at home with his family. His security lights were on.
“I asked my son to open the door and this man just came straight into our house. He was breathing heavily. He had blood on his hands and legs,” Kasera said.
The witness explained how he was in a state of shock after what he had just witnessed.
“I didn't know what was going on..unajua Sisi wajaluo bedroom hua tunaweka silaha sasa Mimi nilikuwa nimebeba Tu stool,” (You know us Luo’s we store weapons in our bedroom but I only had a stool on my hand),” Kasera said.
“Nilijikaza kiume kwa sababu pia Bibi alitoroka. (I faced the situation with boldness because even my wife ran away),” the witness said.
The journalist proceeded to identify himself. He told Kasera that he had been kidnapped with another girl after meeting Oyamo but he managed to escape.
Kasera subsequently took the Journalist to Kadel police post after the incident as the journalist was fearful for his life.
Makini Schools case
Separately, Justice Mugure Thande will be mentioning a case in which Makini Schools is on the spot for expelling two minors after their father raised issues over the institution's regional managing director's aggressive behaviour.
The case was filed last week and the Judge directed it to be listed for today for further directions.
The minors who have sued through their mother are in Grades 3 and 4 respectively. Their father is the current chairperson of the parent's teachers association.
Through Lawyer Apollo Mboya, the minors were two weeks ejected from class. They were given a letter purporting to terminate their education contractual relationship with the school.
In his court papers, Mboya says the expulsion solely on account of the work their father renders as the chairperson of the association of the school has caused them emotional distress and anguish.
According to the court documents, the association in a letter dated July 5 raised several concerns regarding the welfare of the learners.
Some of the issues raised include the high turnover of teachers through dismissal and the general aggressive behaviour of the regional managing director of Makini Schools Horace Mpanza.
The aggressive behaviour; exhibited by Mpanza according to the papers is carrying a firearm within the school compound, smoking within the institution in the presence of learners and erection of a structure as a smoking zone within the school.
Mboya says the rights to education have been violated by the school and wants the July letter expelling them suspended.
The school term has since commenced and the minors are likely to miss their classes.
