A court has restrained Nation Media Group from publishing or republishing any story about Rongo Success Academy or its director Eliud Ondeyo pending the hearing and determination of a defamatory suit filed by the two.
The school in Migori County last month made good its threat and sued the media house over a story it claimed was defamatory.
The story was aired on television channel NTV which is owned by Nation Media Group.
Through lawyer Danstan Omari, the school and its director Ondeyo claim that the April 7 broadcast destroyed their standing and reputation among right-thinking members of the society.
The school had given the station seven days to apologise failing which it would institute civil proceedings against the media house.
Two weeks ago, Rongo Success Academy and its director Eliud Ondeyo Kondeyo filed a suit at the Milimani commercial magistrate court seeking orders to refrain Nation Media Group from publishing or broadcasting any information relating to them.
That application was on Friday allowed by magistrate Eunice Mutie.
"Pending the hearing and determination of the application, the defendant is restrained by themselves, their agents, their servants or anyone acting on their behalf from writing, producing, broadcasting and publishing and or republishing defamatory information on any medium and in any manner whatsoever about the applicant," Mutie directed.
The applicant was given 14 days to file and serve submissions which should be responded to in another 14 days.
The court set July 3 for a mention to take a ruling date.
