A SENIOR bank official is facing arrest for allegedly providing false information in connection with a property dispute involving former CS Raphael Tuju.
Milimani Magistrate Dolphina Alego issued a warrant of arrest against Isaac Okwara for failing to comply with a summons to appear in court yesterday.
It is alleged that Okwara on August 8, 2023, at DCI Headquarters, gave information to a police officer identified as Duncan Maina that Tuju had committed criminal offences.
According to the charge sheet, Okwara accused Tuju of making illegal transfer of a mortgaged property and unlawful receipts.
“On the 8th of August 2023, you Isaac [Okwara], gave false information with the intention to cause Maina to commence criminal investigations against Tuju, which you ought not to have done if the true state of facts in respect to such information had been known to him,” the charge sheet says.
Okwara, however, did not make an appearance in court for plea taking, with the magistrate being informed he is out of the country. Tuju has been listed as a witness in the case.
As this proceeded, an application was filed before the High Court by the bank and Okwara against the office of the DPP and the Chief Magistrates Court in Milimani.
A conservatory order was subsequently issued by Justice Chacha Mwita suspending the proceedings before the Magistrate’s court.
