DCI nabs 2 in Nairobi CBD with bhang worth Sh990,000

They were found with 17 bales weighing 34kgs on arrival from Budalangi, Busia county.

Detectives in Nairobi have arrested two suspects within the Central Business District and seized bhang with a street value of Sh990,000.

The DCI said in a statement the two male suspects were found with 17 bales of the narcotic drug.

“The two were nabbed moments after disembarking from a bus from Budalangi, Busia county just before they boarded a matatu enroute to Kamulu where they reside,” the statement read in part.

“Search in their luggage by anti-narcotics officers saw the seizure of the 17 bales weighing 34kgs, hence their arrest,” it added.

Using or selling bhang, cannabis sativa, is illegal in Kenya.

Kenya’s Narcotic Drugs and Psychotropic Substances (Control) Act states that: “Any person who has in his possession any narcotic drug or psychotropic substance shall be guilty of an offence.” 

The law states that if the court finds that an offender only had cannabis for their own personal use, they may be given a prison sentence of 10 years. 

However, if court finds that the amount of cannabis you had in your possession was for supply, you could face a prison sentence of 20 years to life.

The law also permits the court to impose a fine of Sh1 million or “three times the market value” of the cannabis, whichever is higher.

Cultivating the narcotic drug is illegal too.

If court finds proof that you cultivated bhang, you could be liable to a fine of Sh250,000 or three times the market value of the drug, whichever is higher.

The court may also decide to slap you with up to 20 years jail term, or both.

If it’s found that you gave out your land for cultivation of cannabis, the court will order forfeiture of the land to the government.
