Governor Mutai ouster: 8 lawyers representing Kericho Assembly

Kericho County assembly will be represented by eight advocates during consideration of the proposed removal from office by the impeachment of Governor Erick Kipkoech Mutai.

H & K Law Advocates, in a letter to the Clerk of the Senate, further noted that the county assembly will be calling five witnesses, two of them being elected MCAs.

The law firm noted that Kimutai Bosek will be the lead counsel and will be assisted by advocates Charles Njenga, Sharon C. Mibey, Elias Mutuma, Hillary Kiplangat, Winny Bett, Geoffrey Langat and Elvis Kipkorir.

Mibey is also the deputy clerk of the county assembly. Brian Maingi and Ian Kiplangat are legal assistants while Japheth Kipkirui is the ICT technician.

The law firm said Sigowet MCA Kiprotich Rogony and his Soliat counterpart Albert Kipkoech will be called as witnesses.

The other three witnesses are Joseah Kogo, Erick Koech and Kericho Daughter (pseudonym of the witness).

Mutai is the second governor proposed to be impeached during the current term of Parliament.

He is facing three charges; gross violation of the Constitution and other laws, abuse of office and gross misconduct.

Speaker of the Senate Amason Kingi, in a communication to the House, named the three charges the Governor is facing.

They include gross violation of the Constitution and other laws, abuse of office and gross misconduct.

Under gross violation of the Constitution, the governor is accused of misappropriation, misallocation, and illegal drawings of county revenue and county finances.

He allegedly engaged in various acts of gross violation of Articles 10, 183 and 201 of the Constitution, Sections 102 and 109 of the Public Finance Management Act and the provisions of the Kericho County Rating Act, No. 5 of 2019.

He is accused of presiding over an administration which has deliberately refused, failed, neglected and omitted to automate revenue collection, thus opening up the county’s own-source revenue to pilferage, misappropriation and theft.
