Private detective Jane Mugo has been set free by a Nairobi Court in a case in which she had been accused of threatening to shoot a businessman.
Senior Principal Magistrate Susan Shitubi sitting at the Milimani law Courts ruled that the prosecution had failed to prove its case against Mugo.
In acquitting her, Shitubi took into account the glaring inconsistencies in the evidence produced by two of the Prosecution witnesses.
The magistrate said there is no evidence to support the allegations levelled against Mugo considering that even in the police statements, there's no mention of a pistol or a gun.
"If Mugo had drawn a pistol and pointed at the complainant, this could have been the subject of the initial report," said the magistrate.
"The upshot is that the Prosecution case is full of question marks which can only be exercised in favour of the defence," said Shitubi.
In closing the Magistrate ruled that the Prosecution failed to prove its case beyond reasonable doubt and subsequently found Mugo not guilty of the charges levelled against her.
Mugo was arraigned in court in 2019 charged with threatening to kill Deepa Shah on February 4, 2019, at Kyuna Close within Spring Valley.
She denied the charges and has been out on bond.
During plea taking in 2019, Mugo’s lawyer, Danstan Omari had said his client was being harassed and intimidated.
“Your honour, this is the greatest witch-hunt. Jane has been one of the undercover operatives,” Omari said.
“Your honour, we want the firearm certificate verified by the Firearm Licensing Board,” said Omari.
